1. Agreement to Terms

By scheduling, authorizing, or receiving services from Proformance Heating & Air ("Company," "we," "us," or "our"), you ("Customer" or "you") agree to be bound by these Terms & Conditions. If you do not agree, please do not use our services.

These Terms govern all home services provided by Proformance Heating & Air, including but not limited to HVAC heating, cooling & air quality services (installation, maintenance, and repair), and any related labor, parts, or equipment.

2. Service Authorization

2.1 Scheduling & Access

By booking an appointment, you authorize Proformance Heating & Air and its technicians to access your property at the agreed-upon time to perform the requested services.

  • You agree to provide safe and reasonable access to all areas of the property necessary for service completion.
  • You represent that you are the property owner or have authorization from the owner to approve the work.
  • Rescheduling requests must be made at least 24 hours in advance to avoid a trip charge.

2.2 Scope of Work

All work will be performed as described in the service estimate or work order provided at time of booking or on-site. Any additional work identified during the service visit will be presented to you for approval before proceeding.

3. Pricing & Payment

3.1 Estimates & Quotes

Estimates are based on information provided prior to the service visit. Final pricing may vary if the actual scope of work differs from what was initially described. Written estimates are valid for 30 days from the date issued.

3.2 Payment Terms

  • Payment is due upon completion of service unless otherwise agreed in writing.
  • We accept cash, check, and major credit/debit cards.
  • Financed projects are subject to the terms of the applicable financing agreement.
  • Invoices not paid within 30 days of the service date will accrue a late fee of 1.5% per month on the outstanding balance.

3.3 Cancellations & No-Shows

  • Cancellations made less than 24 hours before a scheduled appointment may be subject to a cancellation fee.
  • If our technician arrives and is unable to access the property or complete the service due to conditions beyond our control, a trip charge may apply.

4. Warranties & Guarantees

4.1 Labor Warranty

Proformance Heating & Air warrants all labor performed for a period of 90 days to 1 year from the date of service completion, provided the system or component has not been altered, misused, or damaged by third parties.

3 Year Labor Warranty for installations

4.2 Parts & Equipment Warranty

Manufacturer warranties apply to all parts and equipment installed. We will assist in facilitating warranty claims where applicable. Parts warranties are separate from labor warranties.

4.3 Warranty Exclusions

Warranties do not cover:

  • Damage caused by misuse, neglect, abuse, or unauthorized modifications.
  • Normal wear and tear or consumable items (e.g., filters, batteries).
  • Pre-existing conditions not caused by our work.
  • Damage resulting from acts of nature, power surges, or events outside our control.

5. Limitation of Liability

Proformance Heating & Air's liability for any claim arising from services rendered shall not exceed the total amount paid by the Customer for the specific service giving rise to the claim.

We are not liable for indirect, incidental, consequential, or punitive damages, including but not limited to loss of use, loss of revenue, or property damage not directly caused by our negligence.

Customers are responsible for disclosing any known hazardous conditions, pre-existing damage, or structural vulnerabilities prior to service.

6. Insurance & Licensing

Proformance Heating & Air maintains general liability insurance and all required state and local licenses to perform HVAC heating, cooling & air quality services (installation, maintenance, and repair) in the state of California. License number(s): LIC #924629.

7. Customer Responsibilities

  • Provide accurate information about the property and systems requiring service.
  • Ensure pets are secured and children are kept away from work areas during the service visit.
  • Clear the work area of personal belongings or obstacles prior to technician arrival.
  • Follow any post-service instructions or recommendations provided by the technician.
  • Notify us promptly of any concerns with completed work so we may address them under warranty.

8. Dispute Resolution

In the event of a dispute, both parties agree to first attempt resolution in good faith through direct communication. If unresolved, disputes shall be submitted to binding arbitration in California in accordance with the rules of the American Arbitration Association. The prevailing party shall be entitled to reasonable attorney's fees and costs.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California. Any legal action must be filed in the courts located in Riverside County, California.

10. Changes to These Terms

Proformance Heating & Air reserves the right to update these Terms at any time. Updated Terms will be posted on our website at proformanceac.com and will take effect upon posting. Continued use of our services constitutes acceptance of any revised Terms.
